Tu relación con las leyes

Como profesor de una materia que se dicta en el 8.º, semestre en la carrera de Contaduría Pública puedo decir con toda propiedad que mi relación con las leyes siempre será el deber ser y no el ser, en el derecho se aplica esa palabra el deber ser, y aunque yo no soy abogado, conozco muy bien de las leyes y también de la administración de la justicia que está escrita, así que solo se debe leer para poder cumplirla a cabalidad.

Explico sobre lo que entiendo de ese enunciado el deber ser las leyes están escritas de una manera que se dictó del cómo se deben cumplir eso es el deber ser, sin embargo, en la realidad de nuestra vida cotidiana se cumple de otra manera eso es lo que se conoce como el ser, muchas veces esas ambigüedades cuando se desconoce de la ley se saltan la letra escrita y se impone una forma de mala del cumplimiento de la ley.

Las primeras unidades de mi materia es muy teórica, pero se fundamenta justamente en deber ser de la ley para que se cumpla tal y como fue escrita, por ejemplo, el presupuesto de la nación no se llama el presupuesto de la nación , su verdadero nombres es La ley del presupuesto de la nación y si eres venezolano siempre escucharás que solo le dicen el presupuesto de la nación, porque hago énfasis en esas palabras, pues yo les explico a mis alumnos que el presupuesto es una ley que debe cumplirse tal y cuál para lo que fue preparado, y aunque pueda existir una desvió de partidas dentro de la misma ley de presupuesto de la nación existe las formas de fondo, el cómo se pueden ejecutar esas partidas, porque precisamente está contemplado en la ley.

De hecho en su primer artículo de la ley de presupuesto público dice lo siguiente Artículo 1°: La presente Ley establece los principios y normas básicos que regirán el proceso presupuestario de los organismos del sector público, y como esta materia se basa en como se deben ejecutar ese presupuesto, previo yo debo enseñarles a mis alumnos a diferenciar el ser, del deber ser.

Puede sonar como un trabalenguas, pero es muy simple el deber ser es tal y como se debe hacer, y el ser es lo que hacen, sin cumplir la ley, por eso digo que mi relación con las leyes se basan en cumplirla y de alguna manera enseñar para que se hagan cumplir, por qué digo esto, porque estoy seguro de que alguno de mis estudiantes estarán trabajando para empresas privadas, pero ninguna de esas empresas privadas se escapan de la ley a menos que ellos como futuros contadores públicos, se salten la ley.

I explain about what I understand of that statement the must be the laws are written in a way that was dictated of how they must be fulfilled that is the must be, however, in the reality of our daily life is fulfilled in another way that is what is known as the being, many times those ambiguities when it is unknown of the law the written letter is skipped and a form of bad of the fulfillment of the law is imposed.

The first units of my subject is very theoretical, but it is based precisely on the duty of the law to be fulfilled as it was written, for example, the budget of the nation is not called the budget of the nation, its real name is The law of the budget of the nation and if you are Venezuelan you will always hear that they only call it the budget of the nation, because I emphasize those words, because I explain to my students that the budget is a law that must be complied with as it was prepared, and although there may be a deviation of items within the same law of the budget of the nation there are the forms of substance, how these items can be executed, because it is precisely contemplated in the law.

In fact, the first article of the public budget law states the following Article 1: The present law establishes the basic principles and norms that will govern the budgetary process of the public sector agencies, and since this matter is based on how the budget should be executed, I must teach my students to differentiate between what is and what should be.

It may sound like a tongue twister, but it is very simple, the duty to be is how it should be done, and the being is what they do, without complying with the law, that is why I say that my relationship with the laws is based on complying with it and somehow teach them to be enforced, why I say this, because I am sure that some of my students will be working for private companies, but none of these private companies escape the law unless they as future public accountants, break the law.
